This writ petition was filed against the order dated 09.10.2003 passed by the Court of the Commissioner (Appeals), Office of the Chief Commissioner of Land Administration, Andhra Pradesh. The said appeal was filed by the petitioners under Regulation 9(3) of A.P. Regulation 2/70. The issue was with regard to grant of a ryotwari patta to the petitioners under the provisions of A.P. Regulation 2/70.
2. Admittedly, the petitioners were granted a ryotwari patta in respect of a part of the land claimed by them. The dispute was with regard to an additional extent which was not covered by the title document under which they were claiming. It is however stated that the boundaries mentioned in the title document enclosed the area in dispute also and therefore, the petitioners were entitled for a ryotwari patta in respect of the said extent also. The Appellate Authority, however, took note of the fact that the matter had been gone into at length even in the earlier round. Upon remand and after due enquiry, the Special Commissioner and Director of Settlements dismissed the claim of the petitioners in respect of the disputed land. He further found that the records showed that the disputed land was classified as assessed waste dry during the pre-abolition period. In that view of the matter, the Appellate Authority concurred with the finding of the Primary Authority and dismissed the appeal. In view of the cogent reasoning of the Appellate Authority, this Court finds no ground to interfere in the matter.
3. The writ petition is accordingly dismissed. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence. No order as to costs.
