This Writ Petition is filed for a mandamus to declare the inaction of the respondents in making payments to the petitioners for the works executed by them under Indiramma Housing Colonies Phase-I, as illegal and arbitrary.
Separate counter-affidavits have been filed by respondent Nos.3 and 5. In the counter-affidavit filed by respondent No.3 he has inter alia stated as under :
“Hence, the Commissioner of Social Welfare, A.P., Hyderabad was requested in W.G. Collector’s Lr.No.Roc.842/2008/E, dated 14-10-2014, for release of an amount of Rs.79.85 lakhs towards levelling of land sanctioned in Madepalli Layout-I colony under S.W.L.A. funds, as special case. Funds are being released by the Commissioner of Social Welfare, A . P . , Hyderabad. Soon after release of funds payment will be made to the beneficiaries committee.”
The learned Government Pleader for Social Welfare submitted that in view of the commitment made by respondent No.3 that payments will be made very soon, reasonable time may be allowed for payment.
In view of the stand taken by respondent No.3, as reflected in the above reproduced paragraph of the counter- affidavit, he is directed to ensure that the bills payable to the petitioners are paid to them within two months from the date of receipt of this order.
Subject to the above direction, the Writ Petition is disposed of.
As a sequel to the disposal of the Writ Petition, WPMP No.33766 of 2014 is disposed of as infructuous.
