As was noted earlier respondent No.2 is found absconding from 15th February, 2007. This is also apparent from the Jail Report, the letter addressed to this Court from Parole-Furlough Squad dated 22.9.2011 clearly indicated that convict-Nandabhai Navghanbhai Patel is absconding till date despite endeavour of the Jail Authority. It is further averred that considering the fact that he was sentenced for 10 years for rigorous imprisonment and has absconded when allowed to go furlough, non-bailable warrant is already issued against him and all efforts are being made to execute the same.
In light of these facts, learned advocate for the petitioner shall make appropriate application to enable the Court to proceed with the matter further.
Matter is adjourned to 27th January, 2012.
