Sri Girja Shankar Mishra, learned counsel for the petitioner after unable to convince this Court about his locus to challange the status of respondent no. 6 in the teeth of two orders of this Court passed in Civil Misc. Writ Petition No. 71736 of 2009 wherein learned Single Judge held that petitioner was not appointed in accordance with law and thereafter order of the Division Bench dated 17.8.2017 passed in Special Appeal No. 150 of 2010 (Gorakhnath Singh Yadav Vs. State of UP and others), wherein special appeal filed by the present petitioner was dismissed upholding the finding of learned Single Judge that petitioner was not appointed in accordance with law, prays for withdrawal of this writ petition as there is no material to substantiate that petitioner was legally appointed and there is illegality in the appointment of respondent no. 6. Writ petition fails and is dismissed. There shall be no further liberty in favour of the petitioner.
