JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE OF ANDHRA PRADESH AT HYDERABAD MONDAY, THE TWENTY EIGHTH DAY OF APRIL TWO THOUSAND AND FOURTEEN :PRESENT:

Gora Govinda Rao S/o Ramulu . Petitioner/Accused AND The State of Andhra Pradesh, Rep by its Public Prosecutor, High Court of AP Hyderabad, through Station House officer, Santhakaviti Police Station, Srikakulam district.
. Respondent Petition under section 438 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to grant anticipatory bail to the petitioner and direct the Santhakavit Police Station, Srikakulam District to enlarge him on bail in the event of his arrest in Cr.No.8/2014 of Santhakaviti Police Station, Srikakulam District.
The petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri S.R. Sanku, Advocate for the Petitioner and of the Public Prosecutor for the Respondent, the Court made the following.
ORDER:
“The petitioner seeks for grant of anticipatory bail. He allegedly committed offences under Section 376 IPC. The petitioner claims that he is a supporter of YSRCP party and seeks his presence in the forthcoming elections. The investigation is still in progress. However, in view of the claim of the petitioner that he is a supporter of a political party and the elections will take place on 7.5.2014, I consider it appropriate to enlarge the petitioner on bail. However, in view of the nature of the offences alleged against the petitioner, I deem it appropriate to enlarge the petitioner on anticipatory bail on terms only.
Accordingly, this Criminal Petition is allowed. The petitioner shall surrender before the learned Judicial Magistrate of First Class, Rajam, within two weeks from today. On such surrender, the learned Judicial Magistrate of First Class, Rajam, shall enlarge the petitioner on bail on a personal bond of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties in a likesum to his satisfaction.
After his release, the petitioner shall appear on every day between 9.00 AM and 6.00 PM before the SHO, Santhakaviti Police Station, Srikakulam District till 31.5.2014.”
