(Per : HONOURABLE MR.JUSTICE P.B.MAJMUDAR) In view of direction of the Supreme Court, these matters are required to be decided positively by 15th July, 2012. The matter is now accordingly placed before this Bench for final disposal.
Learned counsel Mr.Mangukiya, appearing for the appellants in Letters Patent Appeal as well as in petition for writ petitioners, requested for some time on the ground that reply is filed within time as per the direction of the Supreme Court, but he could not file rejoinder in time for certain reasons and according to him now appellants will be required to move the Supreme Court with appropriate application for extension of time to file rejoinder as the time limit granted by the Supreme Court is over. He, therefore, requested for some time in this behalf. He further states that appropriate prayer will be made before the Supreme Court for extending the outer time limit to decide the matter.
Today the matter is kept for final hearing, but since Mr.Mangukiya, learned counsel for the appellants, is not in a position to proceed with the matter and with a view to see that Court may get proper assistance from the leaned advocates appearing in the matters, we accept the request made by Mr.Mangukiya for time to enable him to move the Supreme Court in connection with filing of application for extension of time to file rejoinder, as the time for filing rejoinder is already over, the matter is adjourned to 11th July, 2012.
However, it is clarified that on that day request for adjournment shall not be considered as the matter is pending since long and the Court is required to decide the matter as per the direction of the Supreme Court unless in the meanwhile parties to this proceedings get any order from the Supreme Court for extension of time limit.
