ORDER ON THE CRIMINAL MISC. BAIL APPLICATION Heard the learned counsel for the appellant and the learned AGA for the State on the second bail application in the instant criminal appeal moved on behalf of accused – appellant. The first bail application was rejected 10.01.2014 by this Hon'ble Court.
In the present case bail is being sought in appeal against the order of conviction.
We have perused the judgment and order dated 13.05.2013 passed by the trial court convicting the appellant in S.T. No. 415 of 1992 (arising out of connected Crime No. 309 of 1991, 334 of 1991, 335 of 1991 and 313 of 1991) under Section 148, 302/149, 201 of IPC, Police Station Sindauli, District Shahjahanpur.
We have also perused the order by means of which the first bail application was rejected. It is apparent that the appellant is a sole assailant and specific role of firing has been assigned to the appellant.
Looking to the manner in which the crime has been committed and the gravity of offence and the manner in which the body was recovered no case of grand of indulgence has been made out.
In view of the fact that the appellant is in jail since 13.05.2013, the hearing of the appeal be expedited under Chapter-VIII Rule 33A of the Rules of Court.
Let the paper book be prepared within two months from today and thereafter appeal be listed for hearing before appropriate Bench.
