As per the letter dated 7-12-2012 written by learned Principal Senior Civil Judge, Surat, addressed to Registrar General, High Court of Gujarat, writ of Special Civil Application No.13608 of 2011 dated 28-6-2012 was received by their on 18-7-2012 and, therefore, on the next date of adjournment i.e. 17-7-2012 when application was kept, it could not be served and, therefore, office of Civil Judge, Surat, has returned the said suit to this Court as unserved on 19-7-2012.
This being the fact situation, office has been making stereotype endorsement since long that notice is not received back qua the present petitioner. This shows gross negligence on the part of office. Therefore, Registrar (Judicial) is directed to take appropriate steps against the concerned person and if necessary, hold an inquiry and submit report by the next date.
Issue fresh notice to the petitioner returnable on 10-1-2013.
