Petitioner is the holder of building permit for constructing eight residential villas in the property situated in Survey Nos.52/6 and 52/7 of Mallappally Village. By Exts.P2 and P3 judgments, this Court directed the respondent to issue necessary P-form on the basis of permit to construct villas. However, petitioner submits that by Ext.P4, noting that the petitioner intends to construct an auditorium as well, respondent directed that his application can be considered only after getting an environmental clearance from the Kerala State Environmental Impact Assessment Authority.
2. I am of the view, the plinth area of the villas can be ascertained from the building permit. Therefore, petitioner shall make available the details of plinth area of the villas and after ascertaining the plinth area, necessary P-form shall be issued to the petitioner. Petitioner submits that he has no intention to construct auditorium. The only question is regarding the quantity of earth to be removed from the site. This can be easily done verifying the building permit. Therefore Ext.P4 is set aside. Ext.P1 clearly indicates that the area is 933.52 sq.meter. Therefore after W.P(C).No.33955 of 2014T 2 ascertaining the quantity of earth to be removed from 933.52 Sq.mts, P-form shall be issued to the petitioner by the respondent within a period of three days from the date of receipt of a copy of this judgment.
The Writ Petition is disposed of as above.
