HON’BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.26269 of 2007 ORDER:
The Managing Partner of petitioner-Sri Gopalakrishna Kalamandir states that he is working as such from 2002 onwards and he has been filing the applications before the competent authorities under A.P. Cinemas (Regulation) Rules, 1970 seeking for renewal of B-Form licence from time to time. On 22.12.2006 he filed an application before the 3rd respondent seeking renewal of B-Form licence and the said application was received by the 3rd respondent on 23.12.2006. Thereafter he did not get any information. He filed application before the 1st respondent with a request to the 3rd respondent to issue B-Form licence for the years 2007-2008. But contrary to the said averment, the petitioner filed a reply affidavit stating that the 3rd respondent renewed the B-Form licence on 01.06.2007 and the renewed B Form licence was handed over to one person by name K.B. Prakash, who is not a partner of the firm, but only a son of one of the partners of the firm.
2. Be that as it may, the relief in the writ petition is challenging the action of the respondents in not issuing duplicate B Form licence to the petitioner for the years 2007-08 in spite of the representations dated 01.08.2007 and 17.11.2007. B-Form licence would be issued for a period of one year and by afflux of time, the licence for the years 2007-08 expired long back and no cause of action survives in the present writ petition.
3. The writ petition is accordingly dismissed as infructuous. Pending miscellaneous petitions in this writ petition, if any, shall stand dismissed in consequence. No order as to costs.
