By impugned order dated 7.5.2019, the appellate court in Civil Appeal No.31 of 2004 has rejected the application for additional evidence filed by the plaintiff-petitioners under Order 41 Rule 27 CPC.
In considered opinion of the Court, the order is purely interlocutory in nature. This Court is not inclined to examine its validity at this stage in exercise of supervisory power under Article 227 of the Constitution.
Consequently, the petition is dismissed with liberty reserved in favour of the petitioners to challenge the impugned order alongwith final judgement passed in appeal.
