Heard learned counsel for the parties.
The decision in Special Appeal No. 1454 of 2006 (Hari Om Tatsat Brahm Shukla vs. State of U.P. and others) has been referred to a larger Bench. The larger Bench has heard the matter and has reserved the judgment. The judgment in the aforesaid matter may be pronounced very shortly.
We have been passing interim order permitting the officiating Principal to continue till the end of the academic session in the case like the present one where the senior most teacher, who has been appointed as officiating Principal is entitled to continue till the end of the session if he attains the age of superannuation in the said session under the Government Order.
As an interim measure it is provided the operation of the impugned order dated 16th April, 2010 shall be kept in abeyance.
