Against the order dated 08.03.2017 passed by the Collector, Moradabad under the Enemy Property Act, 1968 (hereinafter referred to as the "Act'), petitioners had earlier approached this Court by filing WRIT - C No.18974 of 2017 which was dismissed vide order dated 03.05.2017 giving liberty to the petitioners to make a reference/representation under Section 18 of the Act.
In pursuance of the aforesaid order the petitioners made a representation dated 12.01.2018 before the respondent no. 2- Joint Secretary, Ministry of Home Affairs, Government of India.
Grievance of the petitioners is that till date no decision has been taken thereon and the matter has been kept pending.
Considering the facts, we dispose of the writ petition with the direction to the respondent no. 2 to consider and decide the representation/reference of the petitioners dated 12.01.2018 by means of a reasoned and speaking order within a period of one month from the date of receipt of a certified copy of this order after notice and opportunity of hearing to all concerned in accordance with law.
