Heard learned AGA for the State and Sri R.K. Singh, learned counsel for the respondent no. 2 and perused the record.
This transfer application has been filed by the applicants Gopal Saran Darbari, Anuj Darbari, Smt. Vidhi, Anupam Darbari and Anurag Darbari with a prayer that the proceedings of Case No. 4531 of 2004 (State Vs. Anurag Darbari and others) under Sections 498-A, 307, 506 and 406 I.P.C. and 3/4 D.P. Act, P.S. Sadar Bazar, District-Saharanpur, pending in the Court of learned CJM, Saharanpur may be transferred to any other district.
From the perusal of record, it appears that in this case the grounds taken by the applicant is that the sister-in-law of the respondent no. 2 was posted at Saharanpur as deputy S.P. and her cousin was posted at Saharanpur as an Additional District Judge now both the officers have been transferred from the district Saharanpur the grounds taken by the petitioner has been exhausted. There remains no ground to transfer the case from Saharanpur to any other district, such prayer is refused. The interim order dated 11.8.2004 is hereby vacated.
Accordingly, this transfer application is dismissed.
Let a copy of this order may be communicated to learned District and Sessions Judge, Ghaziabad within a week, so that the Court concerned may proceed further in above mentioned case in accordance with law.
