The present criminal revision is preferred against the judgment and order dated 24.9.1999 passed by Additional Chief Judge, Family Court, Kanpur Nagar in Case No.711 of 1998 (Smt. Sangeeta Saxena Vs. Gopal Nigam) under Section 13 of Hindu Marriage Act decreeing the suit of opposite party against the revisionist.
Perusal of the record shows that notice sent to the respondent no.2 has been received back after service, but neither revisionist nor respondent no.2 is present. However, learned A.G.A. is present.
Prima facie, this revision is not maintainable as the same has been filed against the divorce decree.
Accordingly, the revision is dismissed both on merits as also for want of prosecution.
In case cause of action still survives, it would be open to the revisionist to move a recall application or avail any other remedy available to him under law and procedure.
