Heard learned counsel for the applicant and learned A.G.A. for the State.
Prosecution of the applicant on the basis of charge sheet dated 3.11.2008 arising out of case Crime No. 103 of 2007-The State Vs. Sahdaiy Devi, under Sections 419, 420, 467, 468 and 471 I.P.C., Police Station Dhina, District Chandauli, is challenged in this application.
I am not inclined to quash the proceedings at this stage. The application is accordingly rejected.
However, since the applicant has not obtained bail till date and non-bailable warrant has been issued against him, it is directed that in the event the applicant appears before the court concerned within two weeks from today and apply for bail in case Crime No. 103 of 2007-The State Vs. Sahdaiy Devi, under Sections 419, 420, 467, 468 and 471 I.P.C., Police Station Dhina, District Chandauli, the same shall be considered and disposed of.
For a period of two weeks, non bailable warrant issued against the applicant shall be kept in abeyance.
In the event, the applicant fails to avail this opportunity, this order shall stand automatically vacated.
