The petitioner is the holder of quarrying permit. Ext.P1 is the permit. Ext.P1 is valid upto12.12.2014. The petitioner wants to remove top soil (ordinary sand) from the site covered by Ext.P1 and transport the same. In view of the judgment of this Court, no permit is required to remove the top soil. However, for the purpose of transporting the top soil, the petitioner requires ‘P form’. This Court in several judgments held that it cannot be insisted that the petitioner shall use the top soil only for the purpose of filling the pit and it is always open for the Geologist to insist comply with the conditions in the permit if the pit formed in the applied area cause threat to others.
W.P.(C) No.30953 of 2014 2 In the light of the above, there shall be a direction to the first respondent to issue ‘P forms’ to the petitioner without insisting for No Objection Certificate or environment clearance certificate within a period of ten days from the date of receipt of a copy of this judgment.
The writ petition is disposed of as above.
