JUDGMENT / ORDER

In the above writ petition, there was an interim order dated 29.01.2010 by which stay was granted of the sale on condition of the petitioner paying 50% of the amount demanded. It is not clear as to whether the interim order was complied with. If the interim order has not been complied with, then if the sale had occurred, definitely the purchaser had to be impleaded. Hence, if the loan is still in default, the respondent Bank shall issue a statement of accounts to the petitioner by registered post and shall proceed against the petitioner for recovery in accordance with law. Writ petition closed, leaving open the contentions of the petitioner.
