Mr.R.J.Halani, Regional Director of Municipalities is present in the Court. After some discussion, learned A.G.P. has, on instruction of Mr. R.J.Halani, Regional Director of Municipalities (who is present in the Court) submitted that the said authority shall withdraw, with immediate effect, the communication dated 27.01.2012 and issue another/fresh instruction after taking into account the judgment passed by the Hon'ble Division Bench and also after taking into account the details and facts submitted/forwarded by the concerned Municipality after the judgment of the Hon'ble Division Bench i.e. the Municipality's letter dated 30th September 2011 which is at Annexure-K (page 77) of Special Civil Application No.2243 of 2012. Therefore, time until 29th March 2012 is allowed to the said respondent authority to withdraw the communication dated 27.01.2012, as stipulated by the said authority during the hearing, and to pass necessary and appropriate orders in consonance with the decision by the Hon'ble Division Bench and the communication dated 30th September 2011 by the concerned Municipality.
