We are of the view that the old principles as laid down by the Supreme Court with regard to approaching of Court on behalf of poor, is no longer applicable because in those days Legal Services Authorities Act, 1987 (hereinafter referred to as ‘the Act’) was not there. At present, the Act has provided for free legal service to the poor under Section 12 of the Act. Therefore, the poor people are also now in a position to come to Court with the legal aid that is being provided by the legal services authorities under the Act without spending any single pie. The petitioner being a legal activist can advise those who are entitled to get benefit in terms of this order. If they approach the appropriate legal services authority, obviously said authority will render free legal advice.
With the above observations, this writ petition is dismissed.
There will be no order as to costs.
Consequently, pending miscellaneous petitions, if any, shall also stand dismissed.
