The Court made the following:
ORDER:
This writ petition is filed for a mandamus to declare the action of the respondents in trying to dispossess the petitioner from Plot No.1553 in Survey Nos.9 and 10 of Kallurupalli Village, Nellore Rural Mandal, Nellore District, without following due process of law, as illegal and arbitrary.
The petitioner averred that she was granted a house site patta vide RCB211/06, dated 15.03.2006, by respondent No.3 and that she has constructed a R.C.C. building and been living therein with her family members. She alleged that respondent No.3, without any authority, has been interfering with her possession of the said property.
At the hearing, there is no representation for the petitioner.
Learned Assistant Government Pleader for Revenue (Assignments), on instructions, submitted that the house plot assigned to the petitioner was unauthorisedly sold to one Shankaraiah and that as the said act is contrary to the Patta Conditions, respondent No.3 is contemplating to initiate proceedings for resumption of the plot. She further submitted that unless resumption proceedings are initiated and appropriate orders are passed, after notice to the petitioner and holding enquiry, respondent No.3 will not interfere with the property covered by the patta.
In view of the above submissions of the learned Assistant Government Pleader, the writ petition is disposed of.
As a sequel, W.P.M.P.No.41777 of 2013 is disposed of as infructuous.
