The writ petition is filed for a Mandamus declaring the action of the respondents 2 and 3 in not allotting essential commodities to the petitioner’s fair price shop No.13 and 14 of Tadepalli village and Mandal, Guntur District, as illegal and arbitrary and for a consequential direction to the respondents 2 and 3 to allot commodities to the petitioner’s fair price shops.
2. The case of the petitioner is that he was appointed as Fair Price Shop dealer for Shop No.13 of Tadepalli village and Mandal, Guntur District in the year 2010 and has been distributing essential commodities to the cardholders without any complaint. While so, the shop of the petitioner was inspected on 13-09-2014 and seized the available stock under cover of a Panchanama including the stock of Shop No.14 to which the petitioner was in-charge and initiated proceedings under Section 6-A of the Essential Commodities Act, 1955. It is stated that though the authorization of the petitioner is valid and subsisting as on date, the respondents 2 and 3 refused to supply stocks to the petitioner’s fair price shop. Aggrieved by the same, the present writ petition is filed.
3. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Civil Supplies.
4. Having regard to the facts and circumstances of the case and since it is stated that the authorization of the petitioner’s fair price shop is valid and subsisting, the respondents are directed to supply stocks to the petitioner’s fair price shop as long as his authorization is valid and subsisting. However, this order will not preclude the competent authority from taking appropriate action in case the petitioner has committed any violations.
With the above direction the writ petition is disposed of. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending, shall stand closed.
