1. Mr.
Manav A. Mehta, learned advocate for the plaintiff tenders purshis dated 2.5.2012. Mr. Manav A. Mehta has also drawn attention of this Court to the photocopy of the email received from the authorised officer of the plaintiff. The purshis along with the email is taken on record. As indicated in the purshis and in the email received by Mr. Manav A. Mehta, the parties have settled the dispute arising in this suit out of Court and hence, he prays for withdrawal of the suit and release of the vessel from the arrest order dated 27.4.2012.
2. In view of the purshis as well as the submissions made by Mr. Manav A. Mehta, the suit is disposed of as withdrawn without effective hearing. The arrest order dated 27.4.2012 is vacated. Notice discharged.
3. Registry is directed to refund the permissible Court fees to the plaintiff in the name of the advocate Mr. Manav A. Mehta.
4. It is open for the plaintiff's advocate to communicate the above order by fax message at their own cost and the authorities are directed to act on fax message and release the vessel forthwith arrested pursuant to the order dated 27.4.2012.
5. The suit is disposed of in terms of purshis without effective hearing. Direct service is permitted today.
