RESPONDENT THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO QUASH THE IMPUGNED ORDER DATED 03.11.2010 IN NO, EAT NO.2 OF 2005 PASSED BY THE HON’BLE PRINCIPAL DISTRICT JUDGE & MEMBER EDUCATION APPELLATE TRIBUNAL, KOLAR AT ANNEXURE-AB TO THIS WRIT PETITION.
THIS PETITION COMING ON FOR REPORTING SETTLEMENT THIS DAY, THE COURT MADE THE FOLLOWING:-
O R D E R This writ petition is disposed off in terms of the settlement reported to this Court vide Memo dated 18.12.2019 which reads as under:
“ JOINT MEMO The parties submit that they have settled the matter amicably amongst themselves and in full and final settlement of all claims between the parties, the petitioner is herewith paying a sum of Rs.8,00,000/- (Rupees Eight Lakhs Only) vide D.D.No.002694 dated 16.12.2019 to the Respondent before this Hon’ble Court. The parties further submit that the Writ Petition may be disposed of recording this Joint Memo between the parties, in the interest of justice and equity”.
2. The said joint memo contains the signatures of the counsel for the petitioner, of the respondent and of the parties as well which are identified by the respective counsel. This Court having interacted with the respondent-employee participating in the proceedings is convinced that the settlement is bonafide and there is no legal or factual impediment for disposing off the writ petition in terms thereof modifying the impugned order.
Ordered accordingly.
The settlement amount, both the parties state consensually, has accrued notionally during the period spread over between 2001 & 2014.
It is open to the respondent-employee to make representation to the petitioner employee concerning his claim for provident fund.
Writ petition is disposed off.
