THE HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CMP.No.257 of 2014 ORDER:
This petition is filed to withdraw O.S.No.297/2013 from the file of XII Additional Chief Judge, City Civil Court, Hyderabad and transfer the same to any other competent Court for disposal according to law.
2. Heard both sides.
3. Advocate for respondents reported no objection for transfer and contended that the allegations levelled against the officer in the affidavit are not correct and submitted that the suit may be transferred to any competent Court for disposal in accordance with law.
4. As seen from the affidavit of the petitioners, the petitioners apprehend that they may not get fair trial before the Presiding Officer and for that reason, sought transfer. Though the said allegation is not correct and once a party expressed that he may not get fair trial, it may cause embarrassment to the officer to proceed with that case.
5. Considering the same and also the fact that other side has no objection, I feel that the suit can be transferred to any other competent Court.
6. For these reasons, O.S.No.297/2013 is withdrawn from the file of XII Additional Chief Judge, City Civil Court, Hyderabad and transferred to XI Additional Chief Judge, City Civil Court for disposal in accordance with law. The XI Additional Chief Judge, City Civil Court shall dispose of the suit, as expeditiously as possible, preferably within six months from the date of receipt of this order.
7. With the above direction, Tr.CMP., is disposed of and as a sequel, miscellaneous petitions, if any, pending in this Tr.CMP, shall stand disposed of.
