HONOURABLE SRI JUSTICE S.RAVI KUMAR CRIMINAL PETITION No.9882 OF 2013 ORDER:
This petition is filed challenging the order in Crl.M.P.No.1643 of 2013 dated 25-4-2013 wherein the learned Magistrate dismissed the petition filed seeking return of passport of the petitioner on the ground that investigation is not yet completed and the other accused are not yet apprehended by the police and at this stage, passport cannot be returned.
2. Now advocate for revision petitioner submitted that police have filed the charge sheet and other accused are deleted from the array of the accused and therefore, the learned Magistrate may be directed to return passport.
3. Considering the facts of the case and submissions of both sides, since the learned Magistrate has not disposed of the application on merits, I feel at this stage, it is not desirable to go on to merits. In view of change of the circumstances, the petitioner can as well approach the learned Magistrate and renew his request for return of passport.
4. Therefore, the petition is disposed by giving liberty to the petitioner to approach the court below and the learned Magistrate shall decide the application on merits without being influenced by dismissal of this petition.
5. As a sequel to the disposal of this Criminal petition, the Miscellaneous Petitions, if any, pending, shall stand dismissed.
