JUDGMENT / ORDER

The petitioner is a student of Bachelor of Technology Court in the Branch Mechanical Engineering under the first respondent University. On the allegation of malpractice in the 3rd semester regular examination, the petitioner was interdicted from appearing from any further examinations. The enquiry having not been concluded, the petitioner could not write the 3rd semester supplementary examinations. Now, despite the convening of the 5th semester examination, the enquiry with respect to the malpractice alleged in the 3rd semester is not yet concluded. In such circumstance, the petitioner can be permitted to appear for the 3rd and 5th semester examinations, but, however, such appearance shall be subject to the enquiry proceedings and the result thereon. Writ petition disposed of.
