1. Heard, learned advocate Mr. Rutvij Oza for the applicant.
2. Present application has been filed by the applicant seeking service to the unserved respondent Nos. 13 to 18, 20 to 23, 25 to 29 and 32 by way of substituted service through publication in the local newspaper having circulation in local area.
3. Having heard the learned advocate for the applicant and considering the averments made in the application, present application is allowed. Prayer made in Para 5(b) of the application is hereby granted and the applicant original plaintiff is permitted to serve the notice of this Court qua the aforesaid unserved respondents through publication in the local daily newspaper, following due procedure for the same. Returnable date is fixed to 10th April 2013.
3.1 At the request of the learned advocate for the applicant it is directed that the learned Court below shall consider the observations made in the order dated 27/12/2012, passed by this Court in main Special Civil Application No. 11168 of 2012, while adjourning the matter.
