1. The present application is filed by the convict through jail seeking temporary bail for a period of 45 days for the purpose of undertaking agricultural operations.
2. Learned APP Mr. Patel invited attention of this Court to jail remarks. The convict is undergoing life imprisonment for offence under Section 302 of the Indian Penal Code in Sessions Case No.33 of 2010, wherein he was convicted by judgment and order dated 26.11.2010.
3. As on 07.07.2012, the convict has undergone two years, four months and twenty-five days. He has enjoyed two parole, one furlough and one temporary bail. Last he was out in the month of May, 2012 for a period of ten days for the marriage of his son. Just prior thereto he was out in the month of April-May, 2012, on furlough for a period of fourteen days.
4. Taking into consideration the above facts, no case is made out to grant temporary bail and hence the same is rejected.
