JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT MADRAS DATED : 31.01.2017 CORAM THE HONOURABLE MR. JUSTICE R.MAHADEVAN Crl.O.P.No.1853 of 2017 Criminal Original Petition filed under Section 482 Cr.P.C. to direct the learned Principal District and Sessions Judge, Villupuram to consider the bail application on the same day on surrender of the petitioners, pending investigation in Crime No.38 of 2017 on the file of the respondent police.

Public Prosecutor ORDER The petitioners alleging that they have been falsely implicated by the respondent for the alleged offences punishable under Sections 147, 148, 294(b), 323, 436, 506 (ii) IPC and 3 (1) (r), 3(1) (s) and 3(2) (v) of the SC / ST Tribes (Prevention of Atrocities) Amendment Act, 2015 seeks a direction to the learned Principal District and Sessions Judge, Villupuram, to consider and dispose of their bail applications that will be filed by them under Section 439 of Cr.P.C. on the same day of their surrender before him in connection with Crime No.38 of 2017 on the file of the respondent police.
2. Heard the learned counsel appearing for the petitioners as well as the learned Additional Public Prosecutor.
3. Considering the nature of the prayer sought for and taking note of the fact that the petitioners are prepared to surrender before the learned Principal District and Sessions Judge, Villupuram, there shall be a direction to the learned Principal District and Sessions Judge, Villupuram, to consider the bail application to be submitted by the petitioners along with their surrender before that Court, on the same day on merits and pass appropriate orders. The criminal original petition is ordered accordingly.
