JUDGMENT / ORDER

When the contempt petition is taken up for hearing today, on behalf of the counsel for the respondent, reply affidavit has been filed, in which, it has been stated that the respondent had attempted to comply with the direction passed by this Court. However, the petitioner had resisted the attempt by the officials for surveying his land. The averments made by the respondent in the reply statement in para 2 is extracted below:
?I respectfully submit that the petitioner obtained an order in W.P.No.19897 of 2014 from this Hon'ble High Court whereby this Hon'ble High Court directs the respondent to look into the representation of the petitioner dated 03.09.2014 with all seriousness/earnestness and to dispose of the same on merits within a period of four weeks from the date of receipt of a copy of the order. On 03.09.2014 the petitioner made a representation requesting to survey the land in S.No.335/29 Vadakoor, Melamudukulathur group, Ramanathapuram District. In pursuance to the order of this Hon'ble High Court, the then Tahsildar has directed the Taluk Deputy Inspector of Surveyor to survey the said land vide his order dated 05.02.2015. In compliance of the order, the Taluk Deputy Inspector of Survey went to survey the land in the presence of petitioner. At that time, the petitioner has not allowed the official to measure the land based on the revenue records and on the other hand, he insisted to survey the land based on his sale deed. Since the petitioner did not allow to survey the land, the land surveyor has reported it on 18.02.2015. But the petitioner suppressed the fact and falsely alleging that order of this Hon'ble High Court was not complied with. If the petitioner allowed the official to survey land based on the revenue records, this respondent is ready to do the same without any hesitation. In this regard, a detailed report has also been sent to the Registrar, Madurai Bench of Madras High Court, Madurai vide this office reference Roc.L1/15543/14, dated 18.03.2015.?
2.In view of the explanation of the respondent as contended in para 2, which is extracted above, I do not think that any order is required to be passed in the contempt petition. Therefore, this contempt petition is closed.
