This Criminal Petition is filed to quash Crime No. 5 of 2012 of Tappachabutra Police Station, Hyderabad.
2. This matter once posted for dismissal on 12/10/2012. On the request of the counsel for petitioner the dismissal caption was deleted and notice was ordered to the second respondent and permission to the counsel for petitioner to take out personal notice by registered post with acknowledgement due and to file proof of service. But the same is not filed and when this matter is listed on 01/4/2014 as per the request of petitioner’s Advocate, petitioner is again permitted to take out notice to second respondent by registered post with acknowledgement due and also by courier and to file proof of service in the Registry. But inspite of such request, no steps have taken and proof of service is not filed. Advocate for petitioner represented that notice was sent but acknowledgement is not returned. When this court asked the Advocate for petitioner to file the postal receipt and courier receipt in proof of service, he requested for a pass over. Accordingly, the matter is passed over and at 01:30 p.m. two receipts with memo are filed. On verification, it is found that these two receipts disclose that notice was sent after pass over of the matter. Inspite of sufficient time, petitioner has not complied the orders, therefore, this criminal petition is liable to be dismissed. Accordingly, Criminal Petition is dismissed for non- compliance of order.
