The instructions supplied to Sri Avneesh Tripathi, Advocate by the University is taken on record.
Heard learned counsel for the petitioner, Sri Avneesh Tripathi, learned counsel for respondent nos.2 and 3 and Sri Rohit Pandey, learned counsel for respondent nos.4 and 5.
The petitioner institution is affiliated with Chaudhary Charan Singh University, Meerut and is engaged in imparting education in two years B.Ed. course. The petitioner has been recommended by the University to participate in B.Ed. counselling course in the category of non minority institution whereas as per the petitioner, its claim should have been forwarded by the University under the category of minority institutions.
Sri Avneesh Tripathi, learned counsel for respondent nos. 2 and 3 on instructions submits that University had issued letter to all the affiliated colleges that if they desire to claim any special status or to participate in the counselling in certain special category, it should submit all the documents by 10th May, 2019, but the petitioner has submitted the documents on 13.05.2019 due to which the case of the petitioner was not considered.
Be that as it may, considering the facts and circumstances of the case and with the consent of the parties, the writ petition is disposed off granting liberty to the petitioner to submit a fresh application/representation before the respondent no.3 Registrar, Chaudhary Charan Singh University, Meerut raising all its grievances within a period of ten days from today. In case, any such application/representation is filed, the respondent no.3 shall decide the same in accordance with law within a period of two weeks from the date of submission of the said application.
In case, if the respondent no.3 finds the petitioner eligible and allow it to participate in the counselling under the minority category, the respondent no.5 shall permit the petitioner to participate in the counselling in the category for which permission has been granted by the respondent no. 3.
