Petitioner challenges the order of learned Judge, Family Court, Erode, Erode District, passed in C.M.P.No.55 of 2016 in M.C.No.5 of 2015 on 10.06.2016.
2. Heard learned counsel for petitioner.
3. Crl.M.P.No.13835 of 2016 has been filed seeking condonation of delay of 44 days in preferring the revision.
4. This Court has perused the affidavit filed by petitioner towards explaining the delay of 44 days in preferring the revision. This Court is not satisfied with the explanation afforded by petitioner. Even on facts, this Court finds that the petitioner has been directed to pay maintenance in sums of Rs.600/- and Rs.700/- to respondents respectively in the year 2006, which sums regularly have not been paid by petitioner. Thereafter, in the year 2016, respondents moved C.M.P.No.55 of 2016 seeking enhancement of maintenance. Court below, under orders dated 10.06.2016, while holding that the second respondent/son has attained majority and hence, he is not entitled to maintenance, increased the maintenance from Rs.600/- to Rs.5,000/- p.m. to first respondent/wife. This Court finds no error in the order under challenge.
Crl.M.P.No.13835 of 2016 is dismissed. In view of the same, Crl.R.C.No.SR.53545 of 2016 is rejected. 09.01.2017 Index: Yes/No Internet: Yes gm To The Judge, Family Court, Erode, Erode District.
