Heard learned counsel for the applicant and learned A.G.A. for the State.
The present anticipatory bail application has been filed by the applicant- Girwar Singh in Case Crime No. 141 of 2019, under Sections 420, 467, 468, 471, 406 I.P.C., Police Station- Kalyanpur, District- Kanpur Nagar with the prayer to grant anticipatory bail to him.
I have perused the averments made in the first information report, the order by means of which the anticipatory bail application has been rejected by the court below as well as the material placed on record.
According to averments made in the first information report, the applicant has induced the first informant to purchase a property on the pretext that the original title holder has executed registered agreement to sale in his favour and the first informant believing the applicant got the sale deed executed in his favour after paying a total consideration of more than Rs.11.5 lakhs. Later on, it is revealed that the alleged agreement released in the favour of the informant is forged.
Learned counsel for the applicant has submitted that the applicant and the informant have entered into compromise and out of Rs.11.5 lakhs, the applicant has already paid Rs.4 lakhs to the first informant. Therefore, the applicant may be granted anticipatory bail.
Learned A.G.A. has opposed the prayer for anticipatory bail.
After hearing learned counsel for the parties and after perusing the allegations made in the first information report and also looking to the seriousness of the allegation as made in the F.I.R., gravity of offence and the severity of punishment and the fact as advanced by the learned A.G.A., no case for grant of any indulgence is made out.
Accordingly, the application for anticipatory bail is rejected.
