Heard learned counsel for the petitioner and learned Standing Counsel for the respondents no.1 and 2.
In view of the order proposed to be passed, notices need not go to the respondents no.3 to 6.
During the course of arguments petitioner has confined his prayer only in respect of prayer no.B, which is reproduced hereinbelow:-
"(B) Issue a writ, order or direction in the nature of Mandamus directing the respondent No.2/Consolidation Officer, Mathura to decide Case No.19 of 2019 (Girraj Vs. State), under Section 42A C.H. Act and Case No.17 of 2017 (Girraj Vs. State), Rule 109A of Consolidation Act within stipulated period."
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the respondent no.2/Consolidation Officer, Mathura to consider and decide the aforesaid case in accordance with law expeditiously and preferably within a period of six months from the date of production of certified copy of this order but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, except upon payment of cost.
