Heard learned counsel for the petitioner and learned Standing Counsel.
The petitioner claims to be resident of village Vishnuipur, Post Jainpura, Tehsil Jalesar, District Etah and is also a ration card holder of the fair price shop in the said village.
The petitioner and several other villagers have submitted a complaint before the respondent no. 2-Sub Divisional Magistrate, Jalesar, Etah for initiating an enquiry against respondent no. 4, who is the fair price shop agent of the aforesaid village inasmuch as, he is not distributing the essential commodities.
It appears that the respondent no. 2 has taken cognizance of the complaint and issued a charge sheet dated 15.1.2019.
Since, the Sub Divisional Magistrate, Jalesar, Etah-respondent no. 2 has taken cognizance in the matter and enquiry is proceeded against respondent no. 4. Therefore, there is no cause of action in the present petition.
Consequently, the writ petition is dismissed.
