Heard Mr. Shivarchan Mishra, learned counsel for applicant and learned A.G.A. for State.
This application under section 482 Cr.P.C. has been filed for a direction to Judicial Magistrate 6th Mathura to conclude trial of Case No. 56 of 2012 (Girraj Sharma Vs. Atul Sharma) under sections 138 N.I. Act, Police Station- Kotwali, District Mathura, within a time bound period.
At the very outset, learned A.G.A. has raised a preliminary objection by submitting that accused Atul Sharma has not yet appeared before Court below.
Consequently, no direction can be issued.
When confronted with above, learned counsel for applicant could not over come the same.
In view of above, present application fails and is liable to be dismissed.
It is accordingly dismissed.
