Heard Mr. K.N. Singh, learned counsel for petitioner, learned Standing Counsel representing respondents-1 to 3 and Mr. B.K. Tripathi, learned counsel representing respondent-4.
Petitioner has approached this Court for a writ of mandamus to direct respondent authorities to decide application dated 09.07.2021 filed by petitioner.
At the very outset, learned Standing Counsel submits that application dated 09.07.2021 has been filed by petitioner without disclosing the provisions under which section aforesaid application has been filed. As such application dated 09.07.2021 falls in the category of a non-statutory representation. Hence, petitioner has neither a legal right to file aforesaid application nor the respondent authority is duty bound to decide the same. Consequently, present writ petition is not maintainable and is therefore liable to be dismissed.
When confronted with above, learned counsel for petitioner could not overcome the same.
In view of above, present writ petition fails and is liable to be dismissed.
It is, accordingly, dismissed.
