Heard learned counsel for the petitioner and the learned Additional Government Advocate.
Under challenge in the instant writ petition is the FIR relating to Case Crime No.670 of 2010 under Sections 406, 420 I.P.C., Police Station Gilaula, District Shrawasti.
We have gone through the consents of the FIR which discloses commission of cognizable offence, as such the same cannot be quashed.
However, considering the allegations levelled in the FIR, which seem to be trivial in nature, we direct that the petitioner shall not be arrested in the aforesaid case crime number unless and until cogent and reliable evidence comes forward against him, provided he cooperates with the investigation, which shall go on.
With the aforesaid observations/directions, the writ petition is disposed of.
