Heard learned counsel for the petitioner.
This writ petition has been filed seeking the following relief:-
"(i) Issue a order or direction to the respondent no.1 i.e. Consolidation Officer, Saidpur, Ghazipur to decide the restoration application dated 20.02.2009 being restoration application no. 683 now 2 of the late husband of petitioner against the order dated 5.5.2001 passed by the respondent no.1 i.e. Consolidation Officer, Saidpur, Ghazipur being case no. 722 of 2000-2001 (Kishori Vs. Dev Nath), within stipulated period as directed by this Hon'ble Court"
Although, it is submitted that the restoration application is pending consideration since the year 2009. However, the order sheet that has been filed on record, namely the order sheet of 11.03.2015 states that the matter had been fixed for rehearing on 25.03.2015. There is nothing on record to indicate as to what transpired thereafter and why the matter has remained pending for almost three years thereafter.
Under the circumstances, this writ petition is dismissed as not pressed granting liberty to the petitioner to file a fresh writ petition annexing thereto the entire order sheet of the proceedings sought to be expedited.
