Having considered the submissions advanced, so also considering the avements made in this application, which are supported by the affidavit of the applicant, this Court is of the opinion that the delay of 41 days caused in preferring the Appeal from Order has been aptly and sufficiently explained and deserves condonation.

For the foregoing reason, the delay of 41 days caused in preferring Appeal from Order is condoned. Rule is made absolute accordingly.
