Heard Mr. Shakil Ahmad, learned counsel holding for Mr. Arunesh Singh, learned counsel for the petitioner and Mr. Vivek Saran, learned counsel for respondent Nos. 2, 3 and 4.
The principal prayer made in the writ petition reads thus:
"1. Issue a writ order or direction in the nature of mandamus, directing the respondents to release the possession of Service Bhukhand No. SS-143 Sector-3 Awas Vikas Parishad Sikandra Yojana Agra in favour of the petitioner, within stipulated period as may be fixed by this Hon'ble Court."
It is not in dispute that allotment of the flat in question was made in favour of the petitioner's brother in 1993. Admittedly, his brother is no more. Further, it appears that the allotment was cancelled as stated by the petitioner himself in his letter dated 9.3.2018 (Annexure 7). In view thereof, the prayer as made by the petitioner cannot be entertained. Hence, the petition is dismissed.
