Heard Mr. G.K. Pandey, learned counsel for revisionist Nos. 1, 2 and 2, Mr. Avanish Pratap Singh,learned counsel for opposite party No. 2 and learned Additional Government Advocate appearing for the State.
Learned counsel for the revisionists submitted that the revisionist no. 1 is the husband, revisionist nos. 2 is the brother- in-law (Jeth), revisionist no. 3 is the sister-in-law (Jethani) of opposite party no. 2. Marriage between the opposite party no. 2, Lata @ Nageena was solemnized on 23.2.1999. General allegations have been made against the revisionist no. 1 and his other family members that they were demanding one Tata Sumo car and Rs. one lac cash as additional dowry and for non fulfillment whereof the deceased was being tortured and maltreated in her matrimonial home. He next submitted that the revisionist nos. 2 and 3, who are jeth and Jethani of opposite party no. 2 living separately from opposite party No. 2 and her husband, having no concern either with her alleged maltreatment in her matrimonial home or with the alleged demand for dowry, yet they have been falsely implicated by her in the present case with the ulterior intention of harassing them.
Per contra, learned counsel for opposite party No. 2 and learned Additional Government have vehemently opposed the prayer for bail.
However considering the fact that revisionist Nos. 2 and 3, who are Jeth and Jethani of opposite party no. 2, it is hereby provided that applicant-revisionist Nos. 2 and 3, Pratap @ Raju and Smt. Laxmi convicted and sentenced in Case No. 644 of 2006 arising out of Case Crime No. 60 of 2005 (State vs. Gireesh Kumar and others) under Sections 498-A, 452, 323 IPC and 4 D.P. Act, police station Mahila, district Agra shall be released on bail forthwith on their furnishing personal bond and two sureties each in the like amount to the satisfaction of the court concerned.
With regard to other revisionist no. 1, his bail application shall be considered subsequently after three months.
