This appeal is filed against the Judgment dated 14th August, 2013 of the learned Single Judge in W.P. (C ) No. 27119 of 2005 . Writ Petition was filed in respect of mutation of 3 cents of property. The learned Single Judge noticed that a per order passed by this Court in C.R.P. No. 572 of 2005, the matter has been remitted to the Land Tribunal, where the matter is still pending.
2. The learned single Judge has observed that the mutation of the property in question will be based on the final result in that dispute. We see no error in the said observation.
W.A. No. 1718 of 2013 2 Learned counsel for the appellant submits that the learned Single Judge has erred in dismissing the Writ Petition as infructuous.
3. Be that as it may, the observation has been made in respect of the mutation of the property. There was no other issue to be decided in the Writ Petition. The learned Judge did not commit any error in dismissing the Writ Petition. We further observe that the mutation shall be abide by the final result of the litigation which is pending before the Land Tribunal.
With this observation, this Writ Appeal is closed.
