Order:
This Writ Petition is filed for the following substantive relief:
“to issue an appropriate writ, order or direction more particularly one in nature of Writ of Mandamus declaring the action of the respondent in interfering with the business of petitioner No.2 in sale and supply of bio-products namely GIAGRO (LIQUID), GIAGRO (GRNUALS), SWARA, G CAPS, GO GREEN and GIA BACTRO which contains Amino Acid and Sea-Weed extract, by relying on the Memo No. PP.II(1)2085/2005, dated 21-01-2006 and the consequential letter No. PP.II(1)2085/2005, dated 21-01-2006 issued by him, as illegal, arbitrary, unconstitutional and without jurisdiction and further to direct the respondent not to interfere in any manner with the Bioproducts business of petitioner No.2 including its dealers/stockiests under the Insecticides Act, 1968 and the Fertilizers Control (Order) Act 1985.”
After arguing the case, Mr.V.R.Reddy Kovvuri, learned Counsel for the petitioners, sought for permission of the Court for withdrawal of the Writ Petition with liberty to his clients to file a fresh one, after issuing notice to the respondent and, with proper and better pleadings regarding the establishment of the manufacturing unit by petitioner No.1.
The request of the learned Counsel for the petitioners is accepted and the Writ Petition is, accordingly, dismissed as withdrawn with liberty to the petitioners in terms of the prayer made.
As a sequel, WPMP.No.45886 of 2014, filed by the petitioners for interim relief, is disposed of as infructuous.
