The present contempt petition has been filed for alleged violation/non-compliance of the judgement and order dated 7.9.2017 passed in Writ Petition No.20941 (MS) of 2017. This Court disposed of the aforesaid writ petition without entering into the merits of the case with direction to the Civil Judge (Junior Division), North, District Sultanpur to consider and decide the Execution Case No.32/33 of 1984 on merit expeditiously, say, within a maximum period of one year strictly in accordance with law.
Learned counsel for the petitioner submits that the execution case was filed in 1984 and the execution proceedings have not yet been finalised though there was a direction that the same be finalised expeditiously within a maximum period of one year. He further submits that almost two years have gone since the order has been passed by this Court.
Mr. Tushar Mittal holding brief of Sri Gaurav Mehrotra, learned counsel representing the respondent submits that now the report of the Amin has been received and the execution proceedings will be finally disposed of within a maximum period of three months. However, an endeavour would be made to dispose of the same within a period of two months.
In view of the aforesaid undertaking and the affidavit of compliance of the presiding officer, the present contempt petition is disposed of finally with direction to the presiding officer to dispose of the Execution Case No.32/33 of 1984 within a period of three months. In case the proceedings are not disposed of finally within a period of three months, the petitioner would have liberty to move an appropriate application for revival of this contempt petition and this Court will proceed against the presiding officer for violating the order dated 7.9.2017 passed by the Writ Court.
Contempt notice stands discharged.
