This writ petition is filed seeking for issuance of a Writ of Mandamus directing the respondent to survey and demarcate the petitioner's property comprised in S.No747, measuring an extent of 5 acres 70 cents, S.No.746/3 measuring extent of 6 acres 68 cents totally 12 acres 38 cents, in Survey number 746/1 measuring an extent of 2 acres 12 cents and entire area in S.No.746/2, measuring an extent of 2 acre 41 cents situated at Sevalur Village, Manapparai Taluk, Tiruchirappalli District on the basis of the representation given by the petitioner dated 17.10.2016 within the time stipulated by this Court.
2.Mr.C.Selvaraj, learned Special Government Pleader takes notice for respondent. By consent, this writ petition is taken up for final disposal at the admission stage itself.
3.The petitioner would state that Sree Meenakshi Mills originally purchased the lands in S.Nos.747, 746/1, 746/2 and 746/3 situated at Sevalur Village, Manapparai Taluk, Tiruchirappalli District. By an order of Board of Industrial Finance and Reconstruction (BIFR) dated 01.04.2002, all the assets and liabilities of the said Sri Meenakshi Mills Limited stand transferred in the name of the petitioner and thereby they became owner and they are in possession and enjoyment of the same.
4.The learned counsel appearing for the petitioner would submit that the petitioner filed an application dated 17.10.2016 to measure and demarcate the property. Since no order was passed, the present writ petition.
5.Considering the limited scope of the prayer sought for by the petitioner, this Court, without going into the merits of the matter, directs the respondent to consider the representation of the petitioner dated 17.10.2016 and take appropriate action on merits and in accordance with law, after providing opportunity to all necessary parties, within a period of twelve weeks from the date of receipt of a copy of this order.
6.With the above direction, this Writ Petition stands disposed of. No costs.
