JUDGMENT / ORDER

The Hon’ble Sri Justice C.V.Nagarjuna Reddy Writ Petition No.40156 of 2014
Dated 27.12.2014
Between:
Ghanta Taraka Ram …Petitioner And Jawaharlal Nehru Technical University Kakinada, E.G.District, rep. by its Registrar and 2 others.
…Respondents Counsel for the petitioner: Mr.M.Manjusha Bharadwaz for Mr.Sreenivasa Rao Velivela Counsel for the respondents: --
The Court made the following:
Order:
This Writ Petition is filed for the following substantive relief:
“to issue an appropriate Writ more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in placing the petitioner in detention list and refusing to give Hall Ticket for BE (CSE) 2nd year first semester examinations, scheduled to be conducted from 29-12 -2014, as illegal, arbitrary and violative of the principles of natural justice and consequently, direct the respondents to furnish Hall Ticket to the petitioner facilitating him to sit for BE (CSE) 2nd year first semester examinations.”
At the hearing, it is not disputed by learned Counsel for both the parties that the issue raised in this Writ Petition is covered by a Division Bench Judgment of this Court in B.Yugandhar V. Principal,
[1]
Kuppam Engineering College , wherein it was held that by a judicial fiat, this Court cannot direct the University to condone the shortage of attendance of the students contrary to its Regulations.
In the light of the ratio laid down in the above- mentioned case, which is being consistently followed by this Court, even if the petitioner has a bona fide reason for not attending the classes, no Mandamus can be issued to the respondents to permit the petitioner to appear in the examinations contrary to the regulations of respondent No.1- University.
For the above-mentioned reasons, the Writ Petition fails and the same is, accordingly, dismissed.
As a sequel to dismissal of the Writ Petition, WPMP.No.50358 of 2014, filed by the petitioner for interim relief, is dismissed as infructuous.
