Order in Appeal From Order No.194 of 2012:-
1. Heard learned advocate appearing for the appellants.
2. It is submitted by learned advocate for the appellant that if necessary direction is given for expeditious disposal of the suit being Special Civil Suit No.437 of 2008, then he will not invite reasoned order.
3. In view of the above, Principal Senior Civil Judge, Ahmedabad (Rural) is directed to dispose of the suit being Special Civil Suit No.437 of 2008 as early as possible preferably within two years from the receipt of present order. It is clarified that the trial court shall dispose of the suit in accordance with law and without being influenced by the order of this Court today as well as the order passed below injunction application.
4. With the above direction and observation, the Appeal From Order stands disposed of.
Order in Civil Application No.6469 of 2012 in Appeal From Order No.194 of 2012:-
In view of order passed in Appeal From Order No.194 of 2012, no order is required to be passed in the Civil Application. The Civil Application stands disposed of accordingly.
